Albayrak wil Jose Maria Sison niet uitzetten

Volgens staatssecretaris Albayrak zal Nederland de Filipijnse communistenleider José Maria Sison voorlopig niet het land uitzetten.

Dat schrijft zij in antwoord op vragen van de PVV, die erop aandringt de man snel uit ons land te verwijderen.

Albayrak is het met de fractie van Geert Wilders eens dat Nederland geen vrijplaats voor terroristen en criminelen mag zijn en dat Sison zich op de Filipijnen zou moeten verantwoorden voor het leed dat hij mensen daar zou hebben aangedaan. Maar de bewindsvrouw stelt ook dat ze de mensenrechten en internationale verdragen, zoals het Europees Verdrag van de Rechten van de Mens (EVRM), moet respecteren.

Op grond van artikel 3 van het EVRM is het niet mogelijk Sison uit te zetten, omdat dat artikel bepaalt dat niemand mag worden onderworpen aan folteringen of aan onmenselijke of vernederende behandelingen of bestraffingen. Dat de doodstraf inmiddels is afgeschaft op de Filipijnen, maakt daarbij volgens Albayrak niet uit.

Het Openbaar Ministerie (OM) staakte eerder dit jaar de vervolging van Sison voor zijn vermoedelijke betrokkenheid bij moordaanslagen op de Filipijnen, omdat er onvoldoende bewijs tegen hem was gevonden. De oprichter van de Communistische Partij van de Filipijnen (CPP) en haar gewapende tak de New People's Army (NPA) (Tagalog: Bagong Hukbong Bayan) werd eind augustus 2007 in zijn woonplaats Utrecht aangehouden.

Sison werd ervan verdacht vanuit Nederland opdracht te hebben geven tot twee moorden op politieke tegenstanders Romulo Kintanar (2003) en Arturo Tabara (2004), gepleegd op de Filipijnen. Bij de moord in 2004 kwam ook Tabara's schoonzoon, Stephen Ong om het leven.

Hoewel Nederland Sison niet kan uitzetten, heeft hij overigens officieel wel de plicht ons land te verlaten. Maar volgens Albayrak is de vraag of dat mogelijk is, omdat de kans groot is dat een ander land hem dan weer zal terugsturen naar Nederland.

Op zich is dat vreemd want als Sison inderdaad niet uitgeleverd ‘kan ‘worden aan de Filipijnen (wat ik overigens betwijfel) dan is er een land dat bij uitstek geschikt is voor een verblijfplaats voor JoMa Sison: Noord Korea.

Uit de link: Greetings To Comrade Kim Jong Il on his Birthday (zie ook indymedia) blijkt dat de Noord Koreaanse leider door het CPP/NDFP zeer bewonderd wordt 'om wat hij heeft gedaan voor Noord korea'?

En wie prijken er op de lijst als degenen die Kim Il Young hartelijk gelukwensen met zijn verjaardag? De eveneens in Nederland verblijvende JoMa Sison maatjes Louis Jalandoni en zijn vrouw Coni Ledesma. Mede oprichters van de Filipijnse communistische partij. Ledesma is overigens ook de 'spokeswoman' van Sison.

Met zulke hartelijke banden tussen de CPP/NDF zal er toch wel plaats zijn voor Sison in Noord Korea?

Je kunt je overigens a priori afvragen waarom Sison (en ook Ledesma en Jalandoni) in Nederland in ballingschap zit en niet in het door hem (hen) zo geadoreerde Noord Korea.

Sorry hoor, maar dan ben je toch niet goed wijs. Er is misschien wel van alles mis in de Filipijnen, maar het is er oneindig veel beter dan in het socio paradijs Noord Korea waar het CPP/NDFP zo dol op lijkt.

Uitspraak: Twaalf jaar voor moord stiefzoon

Een Hagenaar (33) is door de rechtbank in Den Haag veroordeeld tot twaalf jaar gevangenisstraf wegens het doodsteken van zijn stiefzoon(23). Het Openbaar Ministerie had veertien jaar cel geëist.

De Hagenaar stond terecht voor doodslag. Hij bracht in de nacht van 25 op 26 mei van dit jaar zijn stiefzoon met twaalf messteken om het leven. Ook mishandelde hij zijn 17-jarige stiefzoon en zijn vriendin, de moeder van de jongens. Dat gebeurde in hun woning aan de Kritzingerstraat.

Op het moment dat de man de stiefzoon doodstak, lagen de andere twee slachtoffers elders in het huis te slapen. Hij verraste hen in hun slaap. Toch slaagde de jongste stiefzoon er uiteindelijk in het huis te ontvluchten en de politie te waarschuwen.

Na zijn daad vluchtte de man in een gestolen auto. Hij meldde zich twee dagen later op een politiebureau in Amsterdam, waar hij werd aangehouden.

De man had verklaard dat hij in een waas handelde en zich de steekpartij niet kon herinneren. Hij weigerde evenwel zich door een psychiater te laten onderzoeken. De officier van justitie vindt de verdachte een gevaar voor de maatschappij en eiste daarom een langdurige gevangenisstraf.

Albayrak does not want to extradite Joma Sison

According to under minister Albayrak, the Netherlands wil not extradite Filipino communistenleader José Maria Sison for now.

She writes that as a reply to questions of the PVV, who wants to have Sison removed from the Netherlands ASAP.

Albayrak  agrees with Geert Wilders’ fraction that the Netherlands can be no free heaven for terrorists and criminals and that Sison should answer to a judge in the Philippines for the anguish he supposedly caused there. However she also says that she has to respect Human Rights and International treaties, such as the European Treaty of Human Rights.

Op grounds of article 3 of the Treaty it is not possible to extradite Sison because the article states that no one may be subject to torture or inhumane or humiliating treatment or punishment. The fact that the death penalty is abolished in the Philippines does not make any difference according to Albayrak.

The Public Prosecutors Office stopped prosecuting Sison earlier this year for his supposed role in 3 murders in the Philippines because of lack of evidence. The founder of the Communist Party of the Philippines (CPP) and her armed branch the New People's Army (NPA) (Tagalog: Bagong Hukbong Bayan) was arrested end of August 2007 in his residence Utrecht. Sison was suspected of ordering the murders of two political opponents Romulo Kintanar (2003) en Arturo Tabara (2004), committed in the Philippines. During the murder in 2004 also Tabara's son in law, Stephen Ong was killed.

Eventhough the Netherlands cannot extradite Sison (according to Albayrak), he is obliged to leave the country. However, Albayrak doubts this is possible because the chance that another country will just send the man back to the Netherlands. (Or preferably to the Philippines of course)

This in itself is odd because if Sison indeed cannot be extradited to the Philippines (something I question) then there still is an extremely suitable country to offer refuge to JoMa Sison: North Korea.

From the link: Greetings To Comrade Kim Jong Il on his Birthday it is clear that the North Korean ruler is admired highly by the CPP and NDFP (National Democratic Front of the Philippines) for ‘what he has meant to North Korea'.

And who do we find on this list of ‘dignitaries’who fall over themselves in gratulating Kim Il Young with his Birthday? The JoMa Sison croonies Louis Jalandoni en his wife Coni Ledesma. Fellow founders of the  CPP and founders of the (forbidden) NDFP. Ledesma is also an avid 'spokeswoman' for Sison.

With such cordial ties between the  CPP/NDFP surely there must be some place for Sison in Noord Korea?

One cannot help but wonder why Sison (and also Ledesma and Jalandoni) are seeking refuge in the Netherlands rathet than in the so admired North Korea.

Well, if that is not crazy then what is. Ther emight be a lot wrong in the philippines but it is endlessly better than in the CPP/NDFP admired socialist paradise North Korea.
